Terms of service
1. Scope of application
These General Terms and Conditions apply to all orders placed via the Serenity Botanics online store.
2. Conclusion of contract
The presentation of the Products in Serenity Botanics' online store does not constitute a legally binding offer, but an invitation to place an order.
By submitting the order, the Customer makes a binding offer to purchase the selected Products.
Serenity Botanics reserves the right to refuse an order without giving reasons.
After receipt of an order, the customer receives an automatic e-mail confirmation that the order has been received. This does not constitute acceptance of the offer.
The contract is only concluded when Serenity Botanics expressly accepts the order, ships the goods or the Customer receives a shipping confirmation.
Serenity Botanics is entitled to deliver an order in parts and to invoice the delivered parts separately.
3. Prices and payment
The prices quoted are final prices and include VAT. All prices used by Serenity Botanics are quoted in euros and are exclusive of any additional costs such as administrative costs, duties and travel, shipping or transportation costs, unless expressly stated otherwise or otherwise agreed.
In the event of late payment, Serenity Botanics reserves the right to charge interest on arrears at the statutory rate.
4. Delivery
Delivery shall be made to the delivery address specified by the Customer. The terms of delivery are available on the Serenity Botanics website and form an integral part of these GTC.
5. Planned delivery
The Customer must ensure that the actual delivery of the Products ordered by him/her can take place at the time of delivery. Otherwise, Serenity Botanics cannot be held liable for any damage.
6. Transportation and packaging
If the packaging of a delivered Product is opened or damaged, the Customer must obtain a note from the carrier or delivery agent before accepting the Product. In the absence of such a note, Serenity Botanics cannot be held liable for any damage.
7. Living products
Plants are living products and their characteristics are subject to natural variations. Serenity Botanics guarantees that all plants are healthy and free from obvious defects at the time of delivery.
8. Documentation of defects
In the event of defects, the Customer shall provide Serenity Botanics within 2 days with a detailed description and, where applicable, photos or videos of the plants complained about.
9. Inspection obligation of the customer
The Customer is obliged to inspect the delivered Plants immediately upon receipt. Any defects or obvious damage must be reported to Serenity Botanics in writing immediately, but at the latest within 2 days of receipt.
10. Right of withdrawal
Living products such as plants are perishable goods and are therefore excluded from the right of withdrawal. Returns of living products are generally not possible.
11. Exclusion of liability
Serenity Botanics accepts no liability for damage caused by improper care or use of the plants supplied.
12. Data protection
The processing of personal data is carried out in accordance with our privacy policy.
13. Final provisions
The law of the Federal Republic of Germany shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods.
Should individual provisions of these GTCs be or become invalid, this shall not affect the validity of the remaining provisions.
The place of jurisdiction for all disputes arising from this contract shall be the registered office of Serenity Botanics, provided that the Customer is a merchant or a legal entity under public law.
